US News: Hermès Faces Lawsuit for Allegedly Refusing to Sell Birkin Bags to Shoppers
Hermès has faced a lawsuit alleging that it unfairly restricts the sale of its iconic Birkin bags to customers with a certain purchase history.
Two California residents are accusing Hermès of violating antitrust laws by linking the sale of Birkin bags to the purchase of other items, as stated in a proposed federal class-action lawsuit filed in San Francisco.
The lawsuit claims that Hermès sales associates are promoting the purchase of shoes, scarves, jewelry, and other products as a way for customers to qualify to buy a Birkin bag.
‘Only consumers deemed worthy can purchase one’
It is alleged in the lawsuit that Birkin bags cannot be bought online from Hermès, and they are not openly displayed for sale in the company’s retail stores.
“Typically, only those consumers who are deemed worthy of purchasing a Birkin handbag will be shown a Birkin handbag (in a private room),” according to the lawsuit.
The complaint further states that Hermès sales associates do not earn commissions on Birkin bag sales but are encouraged to use the bags to persuade customers to buy additional products.

‘Icon of fashion’
The lawsuit describes Birkin handbags as a symbol of fashion.
They are named after the singer and actress Jane Birkin, who passed away in July at the age of 76.
In 1981, Jane Birkin reportedly discussed her need for a suitable bag with Hermès CEO Jean-Louis Dumas during a flight, leading to the creation of the Birkin bag.
Mr. Dumas designed the bag on the spot and named it after Jane Birkin when it was officially launched in 1984.
The handbag became a coveted status symbol, with some selling for over $10,000 (£7,638).

Reports indicate that the bag’s popularity skyrocketed, solidifying its position as a high-end fashion accessory.
The lawsuit seeks to represent thousands of US consumers who were impacted by Hermès’ alleged sales practices.
Hermès has a presence in about 43 stores across the US, including eight in California.
The plaintiffs are requesting unspecified financial damages and a court injunction against Hermès’ alleged anti-competitive behaviors.
Hermès has not yet responded to requests for comment.
