Whitaker tells Newsmax that Trump’s legal proceedings are a ‘huge legal stretch’

In an interview with Newsmax on Monday, former Acting Attorney General Matthew Whitaker criticized the ongoing legal proceedings concerning former President Donald Trump.

When asked about the type of information former White House aide Hope Hicks might provide in her testimony in Trump’s New York hush money payment trial, Whitaker anticipated questions about “insider day-to-day White House” activities but emphasized the case’s alleged alteration of business records in the crux of the case while appearing on “America Agenda.”

Hick’s testimony “is not material to the underlying facts. The underlying facts are you have an allegation that he altered or made false business records.”

Regarding Manhattan District Attorney Alvin Bragg’s objectives, Whitaker rejected linking the case to election interference, calling it a “complete legal stretch.” Whitaker dismissed the trial’s relevance to federal election violations.

“I just think the whole case is a complete stretch, and what’s just incredulous about is the whole idea that this is a federal election violation at its heart,” he said. “Remember, you know anything that was paid [by Trump] has already been determined as personal through the FEC, Southern District of New York, and by Alvin Bragg’s predecessor, so this case just seems like a complete legal stretch.”

He also raised concerns about Judge Merchan’s impartiality due to his daughter’s involvement in the trial. Whitaker suggested that Judge Merchan recuse himself due to the appearance of a conflict of interest stemming from his daughter’s financial ties to the case.

“Not only does the judge have an actual conflict, but there’s an appearance of a conflict of interest with the daughter making money off of this exact hearing in this exact trial that he is supervising, so I think that’s a serious issue,” he warned.

Concerning the Trump documents case, Whitaker condemned what he viewed as selective prosecution, arguing that only Trump faced scrutiny for alleged wrongdoing while other political figures were not similarly pursued.

“It’s selective prosecution, first of all; only Donald Trump has been gone after for these sets of allegations,” he said. “Let’s talk about the documents case down in Florida, you know, I mean, Bill Clinton, those were deemed to be personal, the tapes he had in his sock drawer. President Biden was given a pass as vice president. Pence was given a pass. President Obama was given a pass. Only Donald Trump on this set of facts has been pursued.”

He highlighted flaws in multiple cases against Trump, including those in Manhattan, Fulton County, and Washington, D.C., predicting their eventual deterioration.

“You know, the Fulton County case is ludicrous, and its legal theories, and it’s continuing to unravel,” he added. “I guess the cherry on top for the whole thing is just D.C. prosecution for crimes that were never contemplated by the drafters of those laws to apply. And so, you know, you’re going to see that these cases are going to continue to deteriorate and not be as strong as the left would have had you believe when they charged them.”
