Apple Allows iPhone 6 and 7 Owners to File Claims for Up to $150

Canadian iPhone owners seeking compensation from Apple’s class-action lawsuit settlement must act before Sept. 2.

The deadline was recently announced following the B.C. Supreme Court’s approval of a settlement offering up to $14.4 million to current and former iPhone 6 and 7 users in Canada.

Eligible individuals can submit a claim as part of the class-action lawsuit, with payments ranging from $17.50 to $150 per person based on the number of claims made, according to lawyer K.S. Garcha.

While similar lawsuits were filed in Ontario, Saskatchewan, and Alberta, the settlement will apply to residents in all provinces except Quebec.

Mr. Garcha anticipates around nine million claims to be filed.

The class-action lawsuit, known as “batterygate,” was initiated in B.C. in 2018 against Apple Inc. and Apple Canada. The lawsuit alleged that Apple’s software updates led to battery defects affecting device performance.

Owners or buyers of Apple iPhone 6, 6 Plus, 6s, 6s, Plus, SE, 7, or 7 Plus devices with iOS 10.2.1 or later for iPhone 6 models, or iOS 11.2 or later for iPhone 7 or 7 Plus purchased before Dec. 21, 2017, may qualify for compensation.

To fill out claim forms online, claimants must provide their name, mailing address, and iPhone serial number.

Michael Peerless, representing the class action, described the settlement as a hard-won achievement after challenging negotiations, noting that the proposed payouts are in line with consumer expectations.

Mr. Peerless explained that going to trial could have prolonged the process by several years without guaranteeing greater compensation. He emphasized the complexity of quantifying damages in such cases.

While Apple has agreed to settle, it doesn’t constitute an acknowledgment of liability. Mr. Peerless mentioned that settlement negotiations drew from similar U.S. legal proceedings, where settlements ranged between $310 million and $500 million.
