Napolitano praises Trump’s strategy of talking to Newsmax outside NYC court as ‘brilliant’

According to former Judge Andrew Napolitano speaking to Newsmax on Friday, Former President Donald Trump’s out-of-court commentary during his fraud trial in New York is a clever strategy to influence the thoughts of listeners, including jurors.

Napolitano acknowledged that Trump should avoid making these comments because he could inadvertently incriminate himself since the government is recording everything. However, he also recognized the brilliance in Trump testifying outside the courtroom without being cross-examined.

He explained that when jurors go home and watch television, they will hear Trump’s comments, which may influence their perceptions. Even though they may not take everything Trump says at face value, it will still linger in their minds.

Napolitano argued that the gag order against Trump is unconstitutional as it violates his freedom of speech, not because he is Donald Trump, but because he is a human being.

Regarding key witness Michael Cohen, Napolitano speculated that prosecutors are trying to paint him as a “monster” so that jurors’ opinions will soften when he testifies. This tactic is intended to make Cohen appear more credible in court.
