Judge Napolitano Tells Newsmax: Trump Going to Prison is Unbelievable
There are speculations circulating that on July 11, Donald Trump might face a prison sentence for his conviction in New York for falsifying business records. This speculation arises from the belief that Judge Juan Merchan is biased against the former president.
However, former New Jersey Superior Court Judge Andrew Napolitano shared with Newsmax on Monday that the likelihood of Trump serving time in prison is very low.
“The verdict was already a travesty,” Napolitano mentioned on “Carl Higbie FRONTLINE.” “The idea of putting a former president behind bars is unimaginable to me.”
“It is theoretically possible, but highly improbable. When sentencing someone, you follow specific legislative guidelines, and there are criteria you must meet,” Napolitano explained.
Ignoring those guidelines, if Judge Merchan still decides to sentence Trump to prison, it would likely be overturned immediately. Trump, who adamantly denies any wrongdoing and asserts that his prosecution is politically motivated, could face a maximum prison term of four years. It is uncommon for individuals convicted of felony falsification of business records in New York to be imprisoned.
If the judge does sentence him to prison despite indicators suggesting non-incarceration, an appeal is expected to follow soon. Napolitano pointed out major flaws in the case, including ambiguity around the underlying charge, highlighting grounds for appeal.
