Crown Seeks 2-Year Jail Term for Saskatchewan Father Who Refused COVID Vaccine for Daughter

Crown prosecutors are seeking a two-year jail term for a Saskatchewan man who prevented his daughter from receiving the COVID-19 vaccine to shield her from the virus.

According to local media reports, the Crown prosecutors expressed their intent to convey a message through a sentencing proposal of two years in jail, three years of probation, and 200 hours of community service.

Jackson, representing himself, is scheduled to appear in the Court of King’s Bench on Aug. 19 to address the Crown’s sentencing request.

Michael Gordon Jackson was convicted in April of breaching a custody order with his ex-wife. The charge stemmed from his failure to return his daughter after a weekend visit in November 2021. At the time, the child, who was 7 years old, primarily resided with her mother.

In February 2022, authorities located Jackson and the girl in Vernon, B.C. Subsequently, a judge found Jackson guilty of contempt of court and sentenced him to 60 days in jail.

Jackson remained in custody until Feb. 13, 2023, with one of the conditions of his release barring contact with his daughter or ex-wife except through legal representation.

Jackson informed the Court of King’s Bench that he had withheld his daughter to prevent his ex-wife from vaccinating her against COVID-19, fearing potential harm from the vaccine.

Court documents reveal that the father attempted to discuss the vaccine with the mother but felt she was not receptive. The custody agreement granted the mother the final decision on the child’s vaccination, as per the documents.

In a prior legal dispute between the parents, the mother secured a police enforcement clause that empowered authorities to return the girl to her if Jackson failed to comply with visitation orders.

Despite an appeal by Jackson, a court order issued on Jan. 5, 2022, granted temporary sole custody and decision-making authority to the child’s mother.
