DOJ Seeks to Dismiss Appeal in Mar-a-Lago Classified Documents Case
The 11th Circuit had earlier approved former special counsel Jack Smith’s petition to discard the case concerning Trump.
On January 29, the Department of Justice (DOJ) filed a motion to voluntarily withdraw its appeal in the classified documents case pending in the U.S. Court of Appeals for the 11th Circuit in Florida.
Hayden O’Byrne, representing the U.S. Attorney’s Office in Miami, stated in the filing that the government had consulted with the attorneys for the two remaining appellees, Waltine Nauta and Carlos De Oliveira, who were defendants along with former President Donald Trump.
The DOJ was in the middle of appealing Florida Judge Aileen Cannon’s dismissal of the classified documents case, as Cannon had decreed that Smith was unlawfully appointed.
