Alan Dershowitz to Newsmax: Trump Indictment Constitutionally ‘Questionable’



Harvard law professor emeritus Alan Dershowitz told Newsmax on Thursday the indictment of former President Donald Trump by a Manhattan grand jury is constitutionally “very, very questionable.”

“When you’re going after the man who is running for president of the United States against the incumbent president, you better have a strong case, and this is about the weakest case I’ve seen in 60 years of law practice,” Dershowitz told “The Record With Greta Van Susteren.” “I’m shocked.”

Multiple media outlets reported Thursday the grand jury empaneled in January by Democrat Manhattan District Attorney Alvin Bragg voted to indict Trump on charges involving a $130,000 payment former Trump attorney Michael Cohen made to porn actress Stormy Daniels before the 2016 election to keep her quiet about an alleged affair she had with Trump in 2006. Trump has repeatedly denied having an affair with Daniels.

The grand jury is on a scheduled break and was not expected to reconvene until after Easter. It is the first time a former U.S. president is facing criminal charges.

Dershowitz, author of “Get Trump: The Threat to Civil Liberties, Due Process, and Our Constitutional Rule of Law,” said Bragg went to lengths he has not seen before to stretch legal statutes in order to find a way to charge Trump.

“This is the worst case of prosecutorial discretion, abuse I’ve seen,” he said. “But how should anybody be surprised? When the attorney general of New York [Democrat Letitia James] and the district attorney both run on the promise to get Trump.

“They have to keep their political promise, so they promised to get him. They get elected, and then they rummaged through all the statute books to try to find something to pin on him, and they can’t find anything in the statute books, so they combined two inapplicable statutes and they say, one plus one equals 11. But it’s zero plus zero equals zero.”
