Appeals Court: Legal Challenge to New Jersey Gun Law Filed Too Early
A federal appeals court has dismissed a challenge by a gun industry group against a New Jersey law that expands the liability of gun manufacturers and sellers. The court ruled that it was too early to make a ruling on a law that had not yet been enforced. The law allows the state’s attorney general to file lawsuits against local gun businesses and is seen as an exception to the federal Protection of Lawful Commerce in Arms Act. The National Shooting Sports Foundation (NSSF) had sued to block the law, but the court determined that there was not enough evidence of an imminent threat to gun owners’ rights. The ruling allows the law to go back into effect. New Jersey is one of the first states to pass this kind of law, and similar laws have been passed in other states as well.
