Biden Considers Implementing a Policy Similar to DACA for Longstanding Undocumented Immigrants

President Joe Biden is currently exploring an immigration policy that would potentially grant a green card to undocumented migrants who have been residing in the country for an extended period, causing “unusual hardship” to their family members if they were to be deported, as reported by Politico reported.

Referred to as “cancellation of removal,” the policy could lead to lawful permanent residence for 4,000 migrants annually. Individuals who have been in the country for more than a decade are eligible to apply for the program, according to the Executive Office for Immigration Review.

This concept was inspired by former President Barack Obama’s initiation of the Deferred Action for Childhood Arrivals program in 2012, according to Politico.

Outlined criteria for the program include, as per an EOIR 2023 document:

  • Your U.S. citizen or lawful permanent spouse, parent, or child would experience extraordinary and exceedingly unusual hardship if you were to be ordered to leave the United States.
  • You adhere to U.S. laws and have not been convicted of any serious crimes that automatically disqualify you.
  • You exhibit “good moral character.”
  • You have been present in the U.S. for a minimum of 10 years.

DACA granted green cards to children who were brought into the country illegally and did not consider any other country as their home.

Just over a month ago, Biden mentioned to the nation’s governors that he was exploring executive actions to address illegal immigration. House Speaker Mike Johnson, R-La., criticized Biden’s contemplation as “election-year gimmicks.”

According to Politico’s report, Biden has refrained from taking any action at the border due to a decline in migration since the record-breaking number of illegal crossings in December. This decrease has resulted in less intense media coverage on the border, allowing Biden to delay action for the time being, as mentioned in the report.

An immigration policy advocate quoted by Politico stated, “They’re in that typical mode of, nothing is on fire right now.”

However, Republicans perceive the massacre in Moscow as a reason to criticize Biden’s lenient border policies and continue seeking answers in the case of student Laken Riley’s death in Georgia, allegedly at the hands of a Venezuelan immigrant.

Recently, over 100 migrants breached a border fence in El Paso, Texas, and overpowered guards.

National Border Patrol Council President Brandon Judd informed Newsmax that “They have been taught by this administration that it is OK to violate our laws. They know and understand that they can do anything they want because they don’t believe that our laws apply to them.”
