Christina Bobb tells Newsmax that Defense Could Rest Soon After Prosecution Presents Case



Republican National Committee attorney Christina Bobb expressed uncertainty on Tuesday regarding whether or not former President Donald Trump’s defense team would present a rebuttal case as the business records trial in Manhattan enters its fifth week on 34 felony counts.

During an interview with Newsmax, Bobb mentioned, “You know, I don’t know. I have been a criminal defense attorney, and I have won cases without presenting evidence. I believe this tactic can be very effective. It is not always necessary to put on a defense for every case.

“There are several strategies they could employ,” she added on “Eric Bolling The Balance.” “It could prove to be effective. I am unsure of their approach. However, I would not be surprised if they chose not to present a defense.”

Trump is facing charges related to falsifying business records, particularly in relation to payments made to Stormy Daniels, which prosecutors claim were intended to conceal information from voters during the 2016 presidential campaign, as reported by The Brennan Center for Justice.

For Trump, the consequences are significant, ranging from a mistrial to conviction on some or all charges.

“If the jurors unanimously determine that the prosecution has not sufficiently proven its case beyond a reasonable doubt, they could acquit Trump of all charges,” explained two former New York City prosecutors.

However, if Trump is found guilty, he could potentially face up to four years of imprisonment for each of the 34 Class E felony counts.

Additionally, there is a possibility of a conviction on misdemeanor charges. While Trump is currently indicted on felony counts, the court could consider lesser included offenses, including misdemeanors.

“The jury will not begin deliberations until all witnesses have testified and all evidence has been presented,” highlighted legal experts.

Trump’s case may proceed to appeal, possibly reaching New York’s highest court, the New York State Court of Appeals.

It is worth noting that the New York State Court of Appeals recently overturned Harvey Weinstein’s 2020 conviction on sex crimes. The majority decision focused largely on what it perceived as significant error by the trial judge in admitting prejudicial testimony during the trial.

Similarly, lawyers representing former President Donald Trump had requested a mistrial, arguing that Daniels’ testimony was prejudicial or could interfere with the jury’s ability to render an impartial verdict. Judge Juan Merchan denied the defense’s motion.
