Congressman McClintock suggests to Newsmax that the courts may compel Biden to release tapes
Rep. Tom McClintock, R-Calif., spoke with Newsmax on Friday and expressed his belief that President Joe Biden’s claim of executive privilege to withhold the audio recordings of his interview with special counsel Robert Hur is “simply inapplicable” and may be challenged in court.
“The president has asserted executive privilege, a concept dating back to the Washington administration that protects the president’s deliberations from Congressional scrutiny. However, in this instance, the conversation was related to a criminal investigation, making the claim of executive privilege irrelevant. This situation is reminiscent of the Nixon tapes, where the Nixon administration’s assertion of executive privilege was eventually overruled by the courts,” McClintock explained.
McClintock emphasized the importance of the ongoing inquiry into the handling of classified information, pointing out the differing treatment of Trump and Biden. He mentioned the significance of the withheld tape in understanding why there are discrepancies in the prosecution of the two individuals.
Regarding the potential criminal liability of Attorney General Merrick Garland for defying the congressional subpoena, McClintock noted that Garland is not shielded from such consequences, citing examples of former Trump officials facing penalties for similar actions.
The House Judiciary and Oversight committees took steps to hold Garland in contempt of Congress after Biden prevented access to the audio recordings. The contempt resolution was advanced by the panels on Thursday.
