Costello continues testifying after being removed from stand by Merchan
A witness in the legal expenses trial of Donald Trump, who faced potential removal from the trial due to his behavior, is set to return to the stand on Tuesday as the trial approaches its conclusion.
Trump’s defense team is counting on Robert Costello’s testimony to challenge the credibility of key prosecution witness Michael Cohen.
However, Costello’s conduct in court on Monday, including making comments under his breath and rolling his eyes, led to Judge Juan Merchan threatening to remove him from the stand. This prompted the judge to briefly clear the courtroom to address the issue with Costello.
The judge rebuked Costello, a former federal prosecutor, for being “contemptuous” and warned him against any further disrespectful behavior. Costello did not respond to requests for comment.
The trial, accusing Trump of falsifying business records as part of Cohen’s scheme to bury damaging stories during the 2016 campaign, is nearing its end. Closing arguments are expected after Memorial Day.
Costello’s testimony is contentious, with the prosecution arguing against his appearance. The judge allowed the defense to question Costello about inconsistencies in Cohen’s statements and to provide rebuttal testimony.
Costello’s history as a federal prosecutor and his strained relationship with Cohen are central to Trump’s defense.
Prosecutors concluded their case with Cohen’s testimony, where he implicated Trump in efforts to silence women with damaging allegations. Trump denies the claims.
The defense’s motion to dismiss the case may be ruled on soon as the trial enters its final days. Trump faces 34 felony counts of falsifying records.
Closing arguments are anticipated after Memorial Day, with the judge planning to give the jury time off before their deliberation.
