Department of Justice Plans to Appeal Judge Cannon’s Decision on Trump Documents Case – One America News Network

The Department of Justice has authorized Special Counsel Jack Smith to appeal Judge Aileen Cannon’s dismissal of President Donald Trump’s classified documents case.

Following Cannon’s decision on Monday, Smith’s office said the dismissal is inconsistent with the “uniform conclusion” of previous courts.
Cannon ruled that Smith was not constitutionally appointed. However, the DOJ argued that Attorney General Merrick Garland is statutorily authorized to name a special counsel.
The planned appeal will go before the 11th Circuit Court of Appeals and possibly on to the Supreme Court.
