ICE Agents Serve as the ‘Main Decision-Makers’ in Deportation Matters – One America News Network

Recently, Border Czar Tom Homan elaborated on how agents from the Trump administration’s Immigration and Customs Enforcement (ICE) are primarily responsible for assessing whether certain “migrants” are affiliated with criminal gangs, which can lead to their deportation.

Homan emphasized that “ICE is the key decision-maker” regarding whether migrants are connected to criminal street gangs, which allows for their deportation under the Alien Enemies Act, a measure utilized by President Donald Trump to accelerate deportation processes during times of “war, invasion, or predatory encroachment.”
“There’s a Homeland Security task force and a significant number of agents involved — But it begins with ICE,” he stated, elaborating that ICE agents perform an in-depth investigation into the social media profiles, criminal histories, and intelligence data of suspected criminal migrants, among other sources of information.
Utilizing the wartime Alien Enemies Act, over 200 non-citizen Venezuelans classified as “enemies” have been deported to a notorious prison in El Salvador known for housing terrorists.
“Individuals designated as enemies of the United States do not enjoy the same degree of due process as those in the regular system,” Homan remarked. “Many claim they lack a criminal record. My law enforcement career spans back to 1984. Numerous gang members do not have prior criminal records. It involves more than just criminal history.”
The application of the Alien Enemies Act by President Trump faced scrutiny from D.C. District Court Judge James Boasberg in March, who described it as “extremely concerning and problematic.” He contended that the “unusual and expansive implementation of a law utilized in the War of 1812, World War I, and World War II occurred during times when there was clear declaration of war and identifiable enemies.”
Despite Judge Boasberg’s concerns, the U.S. Supreme Court recently voted 5-4 to permit President Trump to maintain the enforcement of the Alien Enemies Act for deporting migrant detainees, provided they receive due process and an opportunity to contest their deportations.
“I’ve communicated with top officials at ICE, and they have assured me multiple times: Every individual removed under the Alien Enemies Act was affiliated with a gang and considered a terrorist,” Homan added.
