A federal judge has prohibited the Department of Justice (DOJ) from sharing Special Counsel Jack Smith’s final report with specific members of Congress.

On Tuesday, U.S. District Judge Aileen Cannon issued a 14-page ruling that stops Smith’s report from being accessible to four Congress members. She indicated that the DOJ lacks a legal foundation for this action and labeled its conduct as “startling.”
“Prosecutors hold a unique position in our criminal justice system and are expected to ensure fairness,” Cannon remarked. “The Department of Justice’s stance on Defendants’ Emergency Motion … has not adhered to that duty.” “Ultimately, the Department fails to present any valid justification for the urgent wish to disclose case details to Congress during an ongoing criminal case,” Cannon pointed out.
Judge Cannon expressed concerns that unveiling the report to selected Congress members could jeopardize the fairness of the trial for Trump’s former co-defendants if the information were leaked.
“This Court has no means to enforce any conditions of confidentiality that may exist, if at all. Most importantly, the Department has provided no sound rationale for risking the Defendants’ rights in this manner,” the ruling stated.
