Judge Napolitano Advises Newsmax: Trump Should Avoid Testifying in N.Y. Criminal Case
According to reports, former President Donald Trump stated that he would be willing to testify in his New York criminal trial involving allegations of falsifying business records to conceal payments made to porn star Stormy Daniels.
However, former New Jersey Superior Court Judge Andrew Napolitano cautioned Trump against testifying at his trial, which commenced with jury selection on Monday.
Napolitano explained, “The issue they will have to address at the end of the government’s case is whether Donald Trump will take the witness stand. When a witness gives testimony in a criminal case, they can be cross-examined on the content of their testimony. If the defendant takes the stand, they can be cross-examined on any aspect of their past.”
The case is expected to rely heavily on the testimonies of Daniels and former Trump attorney Michael Cohen, who reportedly made the hush-money payment to Daniels. Trump has denied any wrongdoing and the alleged affair with Daniels.
On his Truth Social account, Trump shared a signed letter from Daniels dated January 30, 2018, in which she denied the affair and the reports of being paid hush money.
Napolitano believes that Trump’s defense lawyer, Todd Blanche, will focus on discrediting the testimonies of Daniels and Cohen to sway the jury in favor of the former president.
