Judge Napolitano assures Newsmax: Trump will not be imprisoned

According to former judge Andrew Napolitano, former President Donald Trump is unlikely to be sentenced to jail time for his New York fraud conviction. Napolitano made this prediction during an appearance on Newsmax on Friday.

Napolitano also commented on the federal gun trial conviction of Hunter Biden, stating that neither case meets the criteria for imprisonment.

He emphasized that Trump has no prior convictions, did not harm anyone, pose a danger to society, or have a victim in his case. Napolitano explained that a detailed checklist with 22 items must be completed by the court to determine the possibility of jail time, and in Trump’s case, he believes these criteria will not indicate incarceration.

Napolitano stressed that decisions regarding incarceration should not be made arbitrarily based on personal bias towards an individual, but rather on filling out the necessary checklist thoroughly.
