Judge Napolitano emphasizes the importance of cross-examination in Trump trial during interview with Newsmax



Former New Jersey Superior Court Judge Andrew Napolitano, now a senior judicial analyst for Newsmax, examined the ongoing N.Y. trial of former President Donald Trump, focusing on defense strategies for cross-examination as a crucial witness testified on Monday.

The first witness, former National Enquirer publisher David Pecker, faced intense scrutiny as the trial began.

Napolitano commented, “There’s not much they can do to question David Pecker’s credibility except point out that he received immunity. They can argue that he is here to please the government and that if he doesn’t say what the government wants, he could face prosecution for his involvement in this alleged deal.”

During an appearance on “Carl Higbie Frontline,” Napolitano discussed the nuanced strategies available to Trump’s defense team, including challenging witness credibility and questioning the motives behind the prosecution. He stressed the importance of effective cross-examination in undermining the prosecution’s case.

Napolitano highlighted the possibility of arguing that the case is an inappropriate use of government law enforcement resources, emphasizing that Trump had been investigated by federal prosecutors who chose not to prosecute for the same events. This could involve putting those federal prosecutors on the stand as part of the defense.

He also pointed out potential tactics to attack witnesses, such as pointing out inconsistencies in their testimony and using past statements to challenge credibility, particularly in the case of witnesses like Michael Cohen.

The trial saw prosecutors and Trump’s defense team clash over allegations of illegal payments and falsified records related to the 2016 election, as reported by CNN.

Both sides delivered their opening statements to set the stage for a contentious legal battle. Defense attorney Todd Blanche staunchly asserted Trump’s innocence, while prosecutors presented a narrative of illicit payments and cover-ups to sway the jury.
