Judge Napolitano Expresses Doubt to Newsmax that Trump Will be Jailed
Former New Jersey Superior Court Judge Andrew Napolitano told Newsmax on Monday that despite Donald Trump facing threats of jail time for violating a gag order in his New York criminal trial for the 10th time, Napolitano does not believe Judge Juan Merchan will actually incarcerate the former president.
“I can’t believe that the judge is going to incarcerate him,” Napolitano said during an interview with “Carl Higbie FRONTLINE.” “I wouldn’t have entered the gag order. As you know, I happen to agree with the president that these are unconstitutional.”
Napolitano suggested a different approach for Judge Merchan: “Sentence the president to some time in jail and suspend that sentence until after the trial is over. By having it hang over the president’s head, it might deter interference with the trial.”
While Napolitano acknowledged that Trump has the right to speak publicly and on social media, he also noted that many judges believe such public statements can influence the jury, potentially compromising the trial’s integrity.
