Judge Napolitano Tells Newsmax: Claims about Biden Being Too Old to Prosecute



If House Republicans proceed with criminal referrals instead of an impeachment inquiry into President Joe Biden, they may hit a dead end, says retired New Jersey Superior Court Judge Andrew Napolitano on Newsmax.

“If the events in question for the criminal referral occurred more than five years ago, the DOJ will not consider it,” Napolitano, the network’s senior judicial analyst, explained on Wednesday’s “National Report.” “The statute of limitations is a complete bar, except when the defendant flees the country. That is not the case here.”

Many of the accusations against the president and his son, Hunter Biden, date back several years and would not fall within the five-year limit. Therefore, a criminal referral for events that happened over five years ago would be merely “symbolic,” according to Napolitano.

Criminal referrals could have a significant political impact but would be turned down by the Justice Department, he added. 

“They cannot pursue a case that falls outside the statute of limitations,” Napolitano reiterated.

Napolitano made these remarks while witnesses, former business associates of Hunter Biden, were testifying before the House Oversight and Accountability Committee.

“The three witnesses who testified this morning have already given depositions under oath,” Napolitano stated. “They have provided testimony privately in front of committee members with committee staff present. The committee members have a transcript of their responses.”

This means that when Chairman James Comer poses a question, he already has a good grasp of the likely answer, Napolitano noted.

“The purpose of today’s hearings is to make public what the committee already knows,” he explained. “The committee’s objective is to demonstrate that Joe Biden was involved in a scheme to illegally enrich his son and indirectly himself while serving as vice president. That’s the crux of the matter.”

The hearing is part of the impeachment investigation into Biden, but Napolitano pointed out that a president can only be impeached for actions taken while in office, not prior acts.

“It may seem strange to impeach him now for something he did while vice president, but remember, one of the consequences of impeachment conviction is disqualification from ever holding federal office again, so that’s the objective relating to prosecuting the president for these actions,” Napolitano clarified.
