Judge Napolitano Tells Newsmax: Unbelievable that Trump will face prison time
Speculation is circulating that Donald Trump may face prison time on July 11 after his conviction in New York for falsifying business records as Judge Juan Merchan is believed to be biased against the former president.
However, former New Jersey Superior Court Judge Andrew Napolitano told Newsmax on Monday that it is unlikely Trump will be sentenced to prison.
“The verdict was already a travesty,” Napolitano stated in an interview with “Carl Higbie FRONTLINE.” “The idea of putting the former president in jail is inconceivable to me.”
Napolitano went on to explain that sentencing is guided by specific criteria and Trump’s lack of prior record, danger to society, or harm to anyone would likely lead to a non-incarceration sentence.
Despite this, if Judge Merchan disregards these guidelines and sentences Trump to prison, it is expected that the decision would be reversed promptly. Trump faces a maximum sentence of four years but jail time for felony falsification of business records convictions in New York is uncommon.
Napolitano pointed out various flaws in the case, including the lack of clarity regarding the charges and jury unanimity, which could lead to an appeal overturning the verdict.
