Lawsuit alleges transgender West Virginia track athlete won against girls 700 times
A West Virginia teen trans athlete, a biological male, has emerged victorious over nearly 300 girls more than 700 times in middle school track events, as detailed in a court document that is part of a lawsuit aimed at halting the implementation of the Biden administration’s new Title IX rules.
According to the court filing, the biological male, known as Becky Pepper-Jackson, allegedly sexually harassed a client represented by the nonprofit civil rights firm Alliance for Defending Freedom (ADF). This led to the teenage girl avoiding changing in the girls’ locker room in order to avoid the discomfort of being in the presence of a male using explicit and inappropriate language towards her.
“The new Title IX rules would mandate many of these harms nationwide,” stated the ADF filing submitted to the U.S. District Court for the Eastern District of Kentucky. The requested stay would pause the implementation of the administration’s updated policies while the case progresses.
The Biden administration’s modifications, which redefine “sex” in federal law to include “gender identity” without considering biological factors, are set to take effect on August 1.
“The Biden administration’s radical redefinition of sex will disrupt the equal opportunities that women and girls have benefited from under Title IX for the past 50 years and will jeopardize their safety and privacy at all levels,” remarked ADF legal counsel Rachel Rouleau in a statement. “While the administration insists that this change will not impact sports, it has already made it clear that men who identify as women should compete in women’s sports under Title IX.”
In April, the 4th U.S. Circuit Court of Appeals ruled 2-1 that West Virginia’s ban on transgender sports violated the rights of the boy, Pepper-Jackson, under Title IX. The court determined that because Pepper-Jackson legally changed his name and has been living as a girl, he must be treated as such — despite defeating biological females in over 700 competitions.
Rouleau’s statement indicated that the administration has supported a male student’s participation in girls’ sports in West Virginia, resulting in numerous victories over female competitors and denying the client’s opportunity to compete in a championship event.
Noting the challenges faced by girls due to this reinterpretation of federal law and broad executive authority, Rouleau emphasized the need to protect women’s rights in Newsmax on Tuesday, stating that “in Joe Biden’s America, women are forgotten.”
