Louisiana Education Chief Instructs Schools to Disregard Biden’s Transgender Guidelines

The Louisiana state superintendent of education has urged school leaders to disregard the Biden administration’s new final rules that use Title IX as protection for transgender students at federally funded schools.

Dr. Cade Brumley stated that the new rules, announced by the U.S. Department of Education last week, directly contradict existing state and federal laws, as reported by The Hill and NOLA.com, referencing a copy of the letter.

The Department of Education expanded the definition of sex on Friday to include transgender individuals in its updated Title IX rules.

While these new rules take effect on Aug. 1, they will not apply to Louisiana without a legal challenge. Brumley advised school leaders not to change their policies or procedures at this time as the Biden administration’s rules conflict with Louisiana’s state law banning transgender girls from participating in girls’ teams.

“The Title IX rule changes endanger students and undermine equal opportunities for females,” Brumley stated in the letter.

The DOE rules also mandate that schools allow transgender students to use facilities of their choice and require teachers to use students’ preferred names and pronouns, which also contradicts Louisiana state law.

Brumley anticipates the Biden administration will attempt to prevent states from enforcing transgender bans in sports, allowing individuals to compete based on their gender identity rather than biological sex. The DOE has proposed that rule separately this month.

Republican lawmakers on Capitol Hill are also taking issue with the DOE rules.

“The Department of Education has put Title IX in jeopardy, endangering the advancements and protections it has provided for women and girls over the years,” said Rep. Virginia Foxx, R-N.C., Chairwoman of the House Education and Workforce Committee, as reported by Newsmax.
