Sebastian Zapeta-Calil, a Guatemalan national, waived his right to appear in court following his indictment on charges of first and second degree murder and one count of arson for the shocking incident on Sunday involving a woman on the F train.
The first-degree murder charges could result in life imprisonment without the possibility of parole.
The alleged perpetrator reportedly approached the unidentified sleeping woman and ignited her clothing, with social media footage capturing him fanning the flames as they engulfed her, according to authorities.
After the attack, he exited the subway and rested on a bench at the platform, later caught on a responding officer’s body camera. This image was subsequently shared publicly in a flyer. A few hours later, three high school students spotted him on the subway, called 911, and he was apprehended.
Zapeta-Calil is scheduled for a formal arraignment at the state Supreme Court on January 7th, where the full indictment will be revealed.
Described by friends at his homeless shelter as a heavy drinker, the accused claimed to police that he was intoxicated that morning and has no recollection of the events.
