Montana Drag Performances Ban Put on Hold by Judge
A federal judge has temporarily halted a ban on drag performances in Montana, just days before one of the state’s largest Pride events is set to take place. The ban, known as House Bill 359, was passed by the state’s majority GOP Legislature and signed into law by GOP Governor Greg Gianforte in May. The law seeks to ban minors from attending what it deems “sexually oriented” performances and prohibits such performances in public places where minors might be present. However, the law’s vague definitions have led to concerns about self-censorship and potential legal consequences for those who fall outside traditional gender and identity norms. The judge argued that the law was unconstitutional and would disproportionately harm drag performers and individuals who do not conform to traditional norms. The temporary restraining order was issued in response to a lawsuit filed by numerous organizations and individuals. The judge’s decision comes just ahead of Helena’s Pride celebration, which celebrates its 30th anniversary in two days.
