Napolitano Urges Newsmax: SCOTUS Needs to Swiftly Decide on 14th Amendment

Former New Jersey Superior Court Judge Andrew Napolitano said a quick resolution must be reached in the Supreme Court concerning the 14th Amendment of the U.S. Constitution and how it applies to the upcoming presidential primaries with states moving to ban former President Donald Trump from appearing on ballots, as reported by Newsmax on Friday.

Napolitano explained that state constitutions mean different things in different states, and the ongoing decisions concerning Trump’s eligibility on ballots are creating confusion. He called for Chief Justice John Roberts to quickly resolve the issue so that everyone knows what the law is and how the 14th Amendment will be applied.

Napolitano’s comments followed Maine Secretary of State Shenna Bellows, a Democrat, removing Trump from the state’s presidential primary ballot, citing the Constitution’s 14th Amendment Civil War-era insurrection clause. Napolitano expressed his surprise at the decision made by an appointed state official without any charges, trial, hearing, or investigation.

He also mentioned the principle of law, federal supremacy, which means that the U.S. Constitution cannot have different meanings in different states. Napolitano criticized Bellows’ authority to make such decisions without proper legal processes.

Regarding Trump’s appeal in the Maine case, Napolitano is expecting a quick resolution from the Supreme Court, setting forth the standards for any disqualification based on the 14th Amendment. He stressed the importance of a formal allegation, trial, and proof of guilt before any disqualification.
