New York’s Nassau County passed a law on Monday banning girls and women’s sports teams from using sports facilities in the county on Long Island unless they exclude biological men who identify as transgender females from competing.

However, the new legislation does not restrict transgender boys and men from competing on men’s sports teams. Since transgender boys and men are biologically female, there is no fear of safety issues for the majority of players and no overwhelming athletic advantage with the inclusion of trans males.
The ruling follows an order from Nassau County Executive Bruce Blakeman that faced a challenge from the New York attorney general, according to NBC News. Blakeman’s order was struck down in May, with a judge ruling that he did not have authority to impose the ban without legislative backing.
In a 12-5 vote, the bill has now passed, which bans transgender women from playing in women’s sports at county-owned athletic facilities, according to CBS News.
Under the new law, if an organizer of girls or women’s sports wishes to book a county-run park or athletics facility, they must ask each member of the teams involved “what sex was marked on their birth certificate,” and expel any teammates who were “not assigned a female at birth,” the bill says.
In response, New York Attorney General Letitia James (D-N.Y.) called out the restrictions as being both “illegal and transphobic.”
Additionally, the New York Civil Liberties Union has stated that they will likely resume its litigation against the Nassau county restrictions on behalf of the Long Island Roller Rebels, which is a women’s roller derby team that states they allow “all transgender women, intersex women, and gender expansive participants” to join.
