Newsmax: Judge Napolitano Suggests Trump Could Still Face Trial Despite Immunity Ruling
In a recent interview with Newsmax, retired New Jersey Superior Court Judge Andrew Napolitano, now a senior judicial analyst, discussed the ongoing legal battle surrounding former President Donald Trump’s claim of immunity from prosecution.
During the interview, Napolitano provided insights into the Supreme Court’s potential protection of presidents from certain criminal charges related to their official actions, a position also supported by Sen. Lindsey Graham, R-S.C.
Sen. Graham mentioned on CNN’s “State of the Union” that the Supreme Court may send the case back to lower courts to clarify the boundaries of presidential immunity. He emphasized that there is no “absolute immunity” in the U.S. Constitution, as reported by Axios.
Napolitano, commenting on the recent Supreme Court oral arguments, concurred with Sen. Graham, stating that a majority of the court is likely to rule in favor of presidential immunity for core official actions under the Constitution. However, actions with personal criminal implications might not be protected by immunity.
Regarding the potential for indictment or obstruction charges in the Jan. 6 case, Napolitano expressed skepticism, saying that the government’s attempt to frame Trump’s actions as personal behavior for personal gain may not hold up in court.
The Supreme Court’s conservative justices, holding a 6-3 majority, signaled support for providing presidents with some level of protection from criminal charges related to their official duties during oral arguments. The justices expressed concerns about the consequences of denying presidents any immunity for less severe actions taken in office.
