Report on Biden’s Classified Documents Raises Concerns for Administration

Reports have emerged about President Joe Biden’s inner circle being worried that special counsel Robert Hur’s investigation into his retention of classified documents could tarnish his 2024 presidential campaign similar to how former candidate Hillary Clinton’s email server did in 2016.

While it is unlikely that Biden will face charges like former President Donald Trump did, Hur’s upcoming report could potentially be damaging to his re-election bid, as per a report by Axios.

Trump has been insisting that Biden’s classified documents were maintained during the decades he served as a senator and vice president, thus disqualifying him from the protection offered under the Presidential Records Act (PRA). This serves as a central point in Trump’s defense.

Expressing his sentiments on this, Trump wrote in a post on Truth Social, “Biden prosecutors are trying to win an election for him that he has no chance of winning. The American people won’t let it happen!”

According to Axios, Hur, a former clerk for Supreme Court Chief Justice William Rehnquist, is expected to release a potentially damning report soon.

Attorney General Merrick Garland of Biden’s Justice Department has pledged to make the special counsel report on Hunter Biden public upon its completion. However, a DOJ official highlighted that Garland has not committed to doing the same with Hur’s report, as he did with special counsel David Weiss’ report.

Last year, Biden remarked, “By the way, my Corvette is in a locked garage, so it’s not like they’re sitting out on the street.” This implies that Biden believes his classified documents are secure, a view shared by Trump, who argues that the PRA allows a former president to retain classified documents but not a former vice president or senator.

Trump is facing 40 charges as part of a case brought against him by special counsel Jack Smith, set to be heard in South Florida.

“Against the backdrop of former President Trump’s indictment on charges of willful and deliberate retention of classified documents, the Biden team’s drip, drip, drip of information made the discoveries seem even worse,” mentioned Anthony Coley, a former senior adviser to Garland, in a now-defunct Messenger article.

When approached by Axios for comments, both the White House and a spokesperson for Biden’s attorney Bob Bauer declined to provide a statement.

In a post on Truth Social, Trump expressed his disapproval of the prosecutors and the investigation, categorizing it as “Biden Investigations for purposes of ELECTION INTERFERENCE. MAKE AMERICA GREAT AGAIN!”

No sitting U.S. president’s Justice Department has ever indicted a former president. However, Biden’s DOJ has done it twice against Trump, once in South Florida (related to classified documents) and once in Washington, D.C. (related to the 2020 election challenge). Local prosecutors in New York City (James’ $370 million civil lawsuit) and Fulton County, Georgia (Willis’ novel election racketeering case) have also indicted Trump. Additionally, Trump has faced personal defamation lawsuits in New York City from E. Jean Carroll.
