Trump Attorney Binnall to Newsmax: Bragg Can’t Ignore Congress



Manhattan District Attorney Alvin Bragg should know that he can’t “willy-nilly” ignore a subpoena from Congress, as his office takes federal funds and is subject to federal law, Jesse Binnall, an attorney for former President Donald Trump, said Wednesday on Newsmax.

“His attempt to have a federal judge interfere should be rejected out of hand,” Binnall told Newsmax’s “Wake Up America.” “If there was another office that was prosecuting people in violation of other civil rights laws and it was a district attorney that was a conservative, Alvin Bragg would be the first one saying that, ‘Yes, Congress has the absolute right to look into this.'”

Congress is looking into the case Bragg is prosecuting against Trump to determine if there needs to be legislation passed to stop political prosecutions and to determine how federal dollars are spent, said Binnall, who is not part of Trump’s New York team.

“On top of that, they’re looking into how federal dollars are spent,” Binnall said. “He absolutely has to comply with that subpoena.”

Bragg on Tuesday filed a lawsuit in federal court against House Judiciary Committee Chair Jim Jordan, R-Ohio, to block the Republican-controlled House Judiciary Committee from access to grand jury information in the case.

Bragg said the House subpoenas are a “transparent campaign to intimidate and attack” the Manhattan court’s legal procedures.

But Binnall said Wednesday that, in his opinion, Bragg is “coming very close” to being in contempt of Congress, and even a more serious crime of obstruction of Congress.

“Jim Jordan is absolutely right,” said Binnall. “Alvin Bragg has taken federal money, money appropriated by Congress. This is an absolutely dilatory, frivolous lawsuit that Alvin Bragg has filed, and other actions he’s taken, the statements he’s made in the press regarding this are contemptuous, at best.”

Binnall said he’s not aware of there being a time when other members of Congress have been sued by a district attorney, and he believes there are “some constitutional problems” in the way Bragg brought his lawsuit.

There is a “good chance” that Bragg will be able to find a friendly judge to rule in his favor, said Binnall, as there “are a number of judges right now who are willing to say that if you’re going after Donald Trump, you’re above the law.”

Binnall said he thinks the case will go through the appeals process quickly, as there is “no legal basis” for Bragg’s lawsuit.
