Trump has no plans to transfer his Georgia case to federal court

Donald Trump will not seek to move a criminal case alleging he conspired to reverse his 2020 presidential election loss in Georgia from state to federal court, his lawyers said Thursday, a development that could simplify the former president’s path to trial.

Trump, the front-runner for the 2024 Republican presidential nomination, and 18 others are charged with pressuring Georgia election officials to overturn his loss in the state to Democratic President Joe Biden in 2020.

Trump and his co-defendants have denied wrongdoing and pleaded not guilty.

Trump’s filing said his decision is based on his “well-founded confidence that this Honorable Court intends to fully and completely protect his constitutional right to a fair trial and guarantee him due process of law throughout the prosecution of his case in the Superior Court of Fulton County, Georgia.”

Trump last month notified the court that he may file to remove, which the new filing says was done “in an abundance of caution.”

“President Trump now notifies the Court that he will NOT be seeking to remove his case to federal court,” the filing states.
