Trump Requests Recusal of D.C. Judge in the Oversight of Recent Indictment
Former President Donald Trump is claiming that he cannot receive a fair trial in Washington, D.C., due to the judge overseeing his case, U.S. District Judge Tanya Chutkan. Trump argues that Judge Chutkan, an appointee of former President Barack Obama, is biased against him because of her political affiliations and connections to President Joe Biden.
Trump plans to ask his legal team to request that Judge Chutkan be removed from the case, and he also seeks a change of venue, as he believes the jury pool in Washington will be predominantly Democratic voters. Trump pleaded not guilty to four charges related to allegations of attempting to overturn the 2020 election.
Judge Chutkan recently rejected a request by Trump’s legal team to have more time to respond to the Department of Justice’s request for an order limiting what Trump can share publicly about the case. Prosecutors made this request after Trump posted a statement on social media indicating that he would retaliate if he was targeted.
Alina Habba, the general counsel for Save America PAC, mentioned the possibility of filing a motion for recusal if they believe the judge is compromised or unable to be impartial. However, the judge will ultimately decide whether she can remain impartial.
Trump’s argument is based on the belief that Judge Chutkan’s political affiliations and connections to President Biden create a bias that prevents her from overseeing the case fairly.
