Trump’s Attorneys Urge Judge to Dismiss ‘Hush Money’ Case, Citing Hunter Biden’s Pardon – One America News Network

Attorneys representing President-elect Donald Trump have urged the judge presiding over his falsifying records case to dismiss the indictment, referencing President Joe Biden’s recent pardon of his son, Hunter.

The documentation was publicly released by Trump’s legal team on Tuesday.
“Yesterday, President Biden issued a 10-year pardon to Hunter Biden that covers any and all crimes, regardless of whether they were charged or uncharged, asserting that his son was ‘selectively and unfairly prosecuted’ and ‘treated differently,’” the filing noted.
“President Biden also stated that ‘raw politics has infected this process and it has led to a miscarriage of justice.’ These remarks represent a striking denunciation of President Biden’s own Department of Justice,” the filing continued. “Manhattan District Attorney Alvin Bragg has engaged in the very type of political theater that President Biden has criticized.”
Bragg’s office is prosecuting Trump for allegedly falsifying business records related to an alleged “hush money” payment to adult film star Stormy Daniels during the final days of the 2016 presidential race. In May, a New York jury convicted Donald Trump on all 34 counts.
However, Judge Juan Merchan has now indefinitely postponed Trump’s sentencing, citing his electoral victory and the protections afforded by presidential immunity.
The District Attorney’s office indicated it had no objections to the postponement.
In their filing, Trump’s attorneys Todd Blanche and Emil Bove also pointed to presidential immunity as grounds for Judge Merchan to dismiss the indictment, as well as framing the prosecution as politically driven and legally flawed.
“This case is built on a fabricated, defective, and unprecedented legal theory surrounding 2017 document entries that were kept hundreds of miles away from the White House where President Trump governed,” the filing claims, insisting “this case should never have come to court.”
“The District Attorney’s actions disrupt the institution of the Presidency and breach the Presidential immunity doctrine as they jeopardize the functioning of the federal government,” the filing further argued.
The filing went on to state that the prosecutor’s “absurd implication that they could simply continue proceedings after President Trump leaves office, over a decade after initiating their investigation in 2018, is unacceptable.”
They also assert the indictment should be dismissed in the “interests of justice,” as the prosecution could lead to “lasting repercussions on the power structure of our republic, and the kind of factional conflict that President Biden condemned in his pardon announcement yesterday.”
“As President Biden stated yesterday, ‘Enough is enough,’” it concluded.
On Sunday, Joe Biden pardoned his son after Hunter pleaded guilty to federal tax offenses and was convicted of federal firearms violations earlier this year.
The District Attorney’s Office has until December 9th to respond to the motion.
