Joe Biden asserts executive privilege to withhold information about his cognitive abilities
The Biden White House is claiming a new privilege for presidents: the ability to hide any evidence of their incompetence.
The conflict over five hours of audio tapes could determine President Biden’s future or establish a precedent of perpetual presidential secrecy in the years to come.
In August 2022, the FBI under Biden raided Trump’s Mar-a-Lago headquarters in a highly publicized operation to confiscate classified documents that the former president was said to have unlawfully possessed.
When classified documents were also found in various locations in President Biden’s residences and offices, Attorney General Merrick Garland appointed Special Counsel Robert Hur to investigate.
Hur interviewed Biden last October and in January released a report stating that the president had knowingly violated federal law.
However, Hur did not recommend prosecution due to concerns that a jury may view Biden as an elderly person with memory issues.
The White House strongly criticized Hur for his statement but refused to release the audio files that could resolve the dispute.
Three months ago, the official White House spokesman for oversight and obstruction, Ian “Baghdad Bob” Sams, claimed that Biden did not assert executive privilege during the Hur investigation because he was transparent and had nothing to hide. Except for his unclear speech and ramblings?
Recently, the Justice Department argued that disclosing the audio tapes would violate personal privacy.
However, Biden was not forced into the presidency and willingly retained classified documents in multiple locations across states.
Congressional Republicans threatened to hold Attorney General Merrick Garland in contempt for refusing to disclose the audio tapes.
The White House officially invoked executive privilege to block access to the tapes.
Biden seems to be using a “Get Out of Democracy Free” card.
White House counsel Ed Siskel justifies the cover-up by pointing to the Republicans’ bad intentions.
Siskel claims that the GOP has no valid reason to access the recordings, suggesting that everyone should accept the White House’s portrayal of Biden as the most intelligent person in Washington.
Siskel states that if Republicans obtained the audio files, they would manipulate them for political purposes, which he deems inappropriate.
Will Biden’s advisors suggest amending the First Amendment to prevent any editing of politicians’ statements?

This situation reveals Washington’s self-centeredness. When asked why he invoked executive privilege, Garland arrogantly stated, “The Justice Department is a fundamental institution of our democracy…I will protect this building and its people.”
Did Garland forget that his duty is to uphold the Constitution, not just protect the White House?
For the White House, the concern is not whether Biden can handle his presidential duties effectively.
Instead, the concern is that the American people are not qualified to assess the president’s verbal slip-ups and incoherence.
The White House should have cited the Americans with Disabilities Act instead of making a dubious claim of executive privilege and threatening to sue anyone for discrimination against the mentally challenged.
