Harvey Weinstein Files Appeal Against LA Rape Conviction Following Overturning of New York Case | Entertainment & Arts Update
Harvey Weinstein is challenging his LA rape conviction, following the recent overturning of his New York rape conviction.
His lawyers argue that he did not receive a fair trial in the 2022 California case, where he was found guilty of rape and sexual assault and sentenced to 16 years in prison.
Weinstein is now seeking a new trial.
The landmark 2020 conviction in New York led to a 23-year prison sentence and sparked the #MeToo movement globally, but it was overturned in April by the state’s highest court due to unfair trial conditions, including allowing unrelated testimonies.
He may face a new trial in New York.
In his appeal against the California conviction, Weinstein’s legal team argues that he was wrongfully convicted of sexually assaulting Jane Doe 1.
The appeal documents also claim that crucial evidence was excluded from the trial, showing that the victim had a prior relationship with a film festival director, casting doubt on the credibility of the accuser.
Additionally, the appeal argues that the judge allowed prejudicial information about Weinstein’s previous New York conviction to influence the case, similar to the situation that led to the conviction being overturned in New York.
Actor ‘confident’ appeal will fail
During his California trial, Weinstein faced charges of assaulting four women but was convicted of one attack on Evgeniya Chernyshova. His defense argues that crucial evidence was improperly excluded, including messages that showed a relationship between Chernyshova and the festival director.
Chernyshova’s team is confident that Weinstein’s appeal will be denied, accusing him of recycling baseless arguments that were previously rejected by the court.
Weinstein has enlisted appellate attorneys, including Jennifer Bonjean, known for her work with Bill Cosby, to overturn his conviction. His team asserts his right to a fair trial and the opportunity to prove his innocence.
The prosecution has until 6 August to respond to the appeal.

Weinstein, dealing with health issues, continues to maintain his innocence and seeks to clear his name. Once a prominent figure in Hollywood, he has expressed remorse for any harm caused by his actions while denying any non-consensual behavior.
He is currently incarcerated in New York.
