Judge Denies Petition to Prevent DOGE from Accessing Government Data

A coalition of state attorneys general sought to prevent the Department of Government Efficiency from accessing governmental data during the ongoing litigation.

A federal judge rejected a request on Feb. 18 from a coalition of state attorneys general aimed at halting the Department of Government Efficiency (DOGE) from obtaining data from seven government agencies, concluding that the states did not meet the necessary criteria for relief.

“The court recognizes that DOGE’s unpredictable actions have led to significant uncertainty and confusion for Plaintiffs, as well as many of their agencies and residents,” U.S. District Judge Tanya Chutkan stated in a 10-page ruling. “However, the mere ‘possibility’ that the defendants may engage in actions causing irreparable harm to the plaintiffs ‘is insufficient.’”

States including New Mexico had requested Judge Chutkan to bar DOGE and Elon Musk, who is leading the DOGE initiative as a special government employee, from accessing data from the Office of Personnel Management, the Department of Education, the Department of Labor, the Department of Health and Human Services, the Department of Energy, the Department of Transportation, and the Department of Commerce.
