Judge Rules Prosecutor Did Not Provide Sufficient Evidence to Prove Musk’s $1 Million Voter Sweepstakes Was Illegal Lottery
A Philadelphia judge ruled that District Attorney Larry Krasner failed to provide enough evidence to prove that Elon Musk’s $1 million voter sweepstakes was illegal under Pennsylvania law. The judge concluded that the program did not meet the requirements of a lottery according to Pennsylvania law, as it did not involve prize, chance, and consideration.
The sweepstakes, organized by America PAC with backing from Musk, targeted swing state voters who supported constitutional rights. Winners were chosen as paid spokespeople for the PAC, with the $1 million prize serving as compensation for services provided.
Krasner’s request for a preliminary injunction to block the giveaway was deemed unnecessary by the judge, who also dismissed claims of deception against Musk and the PAC. The court allowed the sweepstakes to continue operating through Election Day.
Musk, who has contributed millions to America PAC, plans to support GOP candidates in the future. His involvement in voter education programs and primaries was also mentioned post-election.
According to FEC filings, Musk donated around $118.5 million to America PAC between July and October.
