Republicans Seek Supreme Court Intervention to Stop Pennsylvania Ruling on Provisional Ballots



Republicans have petitioned the Supreme Court to stop a ruling in Pennsylvania that allows voters to submit provisional ballots if they have previously sent in mail-in ballots improperly.

This case raises concerns about changes in election procedures, especially with the 2024 elections just around the corner. The focus is on a state law provision stating that a “provisional ballot shall not be counted if the elector’s absentee ballot or mail-in ballot is received by a county board of elections on time.”

The Republican National Committee argued in their application to the justices that the state Supreme Court’s decision violated the Elections and Electors Clauses of the U.S. Constitution. They also stated that the ruling goes against the Purcell principle, which advises against making last-minute changes to election procedures.

Justice Samuel Alito has asked for a response to the RNC’s petition by 4 p.m. ET on Oct. 30.
