Trump Administration Requests Supreme Court Intervention to Prevent Reinstatement of Probationary Employees



The administration argued that a lower court overstepped its authority regarding the reinstatement.

The Trump administration has requested the Supreme Court’s intervention to block a lower court ruling that mandated the reinstatement of thousands of terminated probationary employees within the federal government.

On March 24, Acting Solicitor General Sarah Harris submitted an emergency appeal, seeking an administrative stay from the Supreme Court.

“This would maintain the current situation, allowing the probationary employees mandated for reinstatement by the district court to remain in a paid administrative leave status,” she explained.

“Moreover, it would relieve agencies from the requirement to continue efforts to transition these employees to full duty and would exempt applicants from any necessity to assign work to the reinstated employees or to submit further reports detailing those actions to the district court.”
