Federal Court of Appeal Rules in Favor of Privacy Watchdog in Ongoing Facebook Lawsuit
A panel of judges has ruled that Facebook violated federal privacy law by not adequately informing users of the risks to their data when signing up for the popular social media platform.
The Federal Court of Appeal’s recent decision states that Facebook, now known as Meta, did not obtain the necessary consent required by the Personal Information Protection and Electronic Documents Act between 2013 and 2015.
This ruling overturns a previous 2023 Federal Court judgment.
The Court of Appeal’s latest decision found that Facebook allowed millions of apps onto its platform without sufficient supervision.
It was determined that the Federal Court’s failure to consider the relevant evidence on this issue was a legal mistake.
In response to the ruling, Privacy Commissioner Philippe Dufresne stated that it recognizes the obligation for international companies whose business models rely on user data to comply with Canadian privacy regulations.
