MPs Warn that Reckless Cyclists May Face Up to 14 Years in Prison
MPs have expressed the need for stricter penalties for dangerous and careless cycling to act as a deterrent and ensure equal accountability for all road users.
A new law has been approved that will impose up to 14 years in prison for cyclists who cause death by dangerous cycling. Additionally, cyclists causing serious injury by dangerous cycling or death by careless or inconsiderate cycling may face up to five years in prison.
These amendments, proposed by Conservative MP Sir Iain Duncan Smith, will be included in the Criminal Justice Bill currently progressing through Parliament. Sir Iain emphasized the urgency of changing the law on cyclists to ensure justice and accountability.
If passed, cyclists who cause death through careless cycling will face the same penalties as drivers and motorcyclists. Transport Secretary Mark Harper supported the amendments, highlighting the importance of holding reckless individuals accountable under the full weight of the law.
The legislation aims to protect law-abiding cyclists, pedestrians, and other road users. Dangerous cycling is already considered an offense under the Road Traffic Act, referring to situations that pose a risk of injury to individuals or property damage.
The proposed changes require cyclists to maintain their equipment properly, including ensuring their brakes are in working order. The new legislation addresses the case of Matthew Briggs, whose wife was killed in a collision with a cyclist whose bicycle lacked front brakes.
A Department for Transport report in 2018 identified the need for legislative changes to tackle dangerous cycling causing serious injury or death. Comparing British road safety laws with those of other countries, the report suggested that stricter legislation would benefit all road users.
While Cycling UK expressed concerns about the focus solely on cycling offenses, urging the government to address broader issues in road traffic laws. The organization emphasized the need for a comprehensive review of road safety laws to ensure the safety of all road users.
