The Indian High Court’s Decision to Uphold the Controversial Reorganization of Kashmir Seen as a Strategic Victory in Geo-political Analysis



India has ended the special status for the Muslim-majority region of Jammu and Kashmir and has reiterated its right to Pakistan-controlled Kashmir through an Indian Supreme Court decision earlier this month. The move is seen as strengthening Prime Minister Narendra Modi’s position in India’s geo-political landscape. The former state of Jammu and Kashmir was split by India four years ago into two federally governed territories–Jammu-Kashmir and Ladakh, following the abolition of Article 370 of the constitution, a provision that had been in place for over seventy years. This led to a legal challenge to the reorganization by the regional political party the Jammu and Kashmir National Conference, which the Indian Supreme Court recently rejected. The court called the decision “historic,” while experts called it a “very big victory” for Modi. The reorganization and the Supreme Court’s subsequent verdict have strengthened India’s case, tapping into strategic security concerns and helping the Indian government to gain control that would bolster defense and security measures in the region. Meanwhile, Pakistan opposed the decision, and China has called the reorganization and the related verdict “unacceptable.” Despite the international opposition, the Indian government is moving forward with plans to hold elections in Jammu and Kashmir by next September, and the region is expected to become a state with its own elected representatives, rather than being directly governed by the federal government. The move to end Article 370 has been met with increased investment, attracting proposals worth over $10 billion across 42 industrial sectors in the region, according to the Indian government. These decisions have also led to increased tensions with China and Pakistan, with China viewing India as a regional rival and both countries wanting to see India’s rise curbed. Nonetheless, India believes that the measures are necessary to promote development and progress in the region.
