Dershowitz Tells Newsmax: I’ve Never Witnessed a Judge Behave Like Merchan



Harvard Law professor emeritus Alan Dershowitz expressed his astonishment at Judge Juan Merchan’s behavior during former President Donald Trump’s trial in Manhattan. Dershowitz, who has extensive experience in courtrooms worldwide, told Newsmax that he has never witnessed a judge act in the manner displayed by Judge Merchan. The judge threatened to strike the testimony of the case’s only defense witness, Robert Costello, a former legal adviser for ex-Trump lawyer Michael Cohen, because he did not like how Costello was looking at him.

“When nobody’s in the courtroom, when he throws the journalists out, and when he throws the jury out, his true self comes to the fore,” Dershowitz told Newsmax’s “Newsline” Wednesday, while describing the judge’s threat to strike Costello’s testimony. Dershowitz referenced the movie ‘Taxi Driver,’ comparing Merchan’s behavior to a scene from the film.

Dershowitz criticized Merchan for making biased rulings when the media is not present, stressing the importance of televising trials for public scrutiny. He questioned the judge’s motives for not allowing the Trump trial to be televised, suggesting that transparency is necessary for evaluating witness credibility and bias.

During his interview, Dershowitz expressed frustration over the court’s decision to adjourn until after Memorial Day, delaying the outcome of the trial. He highlighted Cohen’s financial interests in the case, pointing out his efforts to profit from his testimony through book deals and merchandise sales.

Dershowitz also commented on the FBI’s search of Trump’s Mar-a-Lago estate, emphasizing the standard procedure of authorizing deadly force when serving search warrants. He emphasized the importance of upholding defendants’ constitutional rights and criticized Judge Merchan’s handling of the trial.

In a separate interview with Newsmax’s “The Record With Greta Van Susteren,” Dershowitz reiterated his concerns about the judge’s actions, particularly regarding the defendant’s Sixth Amendment rights. He emphasized the significance of fair trials and accountability in the legal system.
