The illegal tobacco trade in Canada isn’t just a domestic issue. It provides significant financial benefits to organized crime and terrorist groups globally, including Hamas.

The growth of Canada’s illicit tobacco trade leads to provinces losing billions in tax revenue while empowering criminal networks both within the country and internationally.

By 2023, the RCMP estimates that 175 criminal organizations are involved in illicit tobacco trade. These organizations exploit high cigarette taxes and take advantage of the relaxed enforcement of on-reserve tax exemptions under the Indian Act, originally meant for First Nations people.

What was once a localized issue in parts of Ontario, Quebec, and Atlantic Canada has now spread nationwide, particularly in British Columbia and Alberta due to the lucrative revenue potential.

Indigenous communities, particularly in Ontario and Quebec, have been linked to cross-border illegal tobacco trafficking. Law enforcement hesitancy to enforce the law on reserves has led to First Nations collaborating with criminal networks involved in the nationwide distribution of illegal tobacco. The significant price difference between legal and illegal cigarettes, along with technological advancements, facilitates exploiting cost-saving and profitable opportunities.

The illicit market operates on basic supply and demand principles, attracting more players as profits increase. The lack of stringent enforcement and legal ambiguity further encourage the involvement of new entities in this lucrative illicit trade.

A comprehensive approach is necessary to effectively tackle Canada’s illegal tobacco trade, addressing issues like high taxes, weak law enforcement, and misuse of legal loopholes.

With the illicit trade depriving provinces of tax revenue and aiding organized crime and terror groups, the stakes are high.
