Andrew Napolitano Tells Newsmax: Trump’s Appeal Is ‘Automatic’
Retired New Jersey Superior Court Judge Andrew Napolitano told Newsmax on Friday that Former President Donald Trump’s legal team has an automatic appeal of his guilty verdict in a New York criminal trial.
Trump was convicted by a jury on all 34 felony counts of falsifying business records related to payments made to adult film star Stormy Daniels. Trump’s attorney, Todd Blanche, vowed to file an appeal.
Napolitano commented on the appeal process, stating that “the judge did not require the jury to articulate or agree on what the underlying crime was,” and pointed out flaws in the jury’s decision-making process.
Napolitano emphasized the need for jurors to agree unanimously on every element of every crime for a guilty verdict, which did not occur in Trump’s case, leading to what he believes is an automatic appeal.
Regarding the verdict, Napolitano expressed his disappointment as a friend of Trump for many years, acknowledging the hurtful nature of the legal proceedings against him.
