Whitaker Urges Appellate Courts to Show Trump Favor, Says Newsmax

Former acting Attorney General Matthew Whitaker told Newsmax on Thursday that he believes appeals courts would be inclined to support former President Donald Trump in his legal battles.

While appearing on “Eric Bolling The Balance,” Whitaker said that appeals courts are likely to be skeptical of novel legal ideas and theories presented in court.

He expressed confidence that appellate courts will prioritize legal correctness and overturn trial court decisions that err on the law.

Whitaker stated, “They’re going to be right on the law, and whether it’s a special counsel like Jack Smith or judges in the trial court, they will be reversed if they are wrong on the law. Donald Trump will continue to prevail.”

Whitaker’s remarks came after a legal battle in the U.S. Supreme Court involving Trump’s claim of immunity from prosecution for actions taken during his presidency.

Conservative justices of the Supreme Court indicated their support for giving U.S. presidents some level of protection from criminal charges related to their actions in office.

Trump, aiming to return to the White House, appealed against lower courts’ rejection of his request for immunity from election-related criminal charges on the grounds of his presidency during the actions leading to the indictment.
